Shipment will be made in accordance with instructions issued by Company’s shipping department. Customer assumes risk of all loss and damage resulting from any cause whatsoever when the Products are delivered to carrier, to Customer, or to Customer’s agent, whichever occurs first. All required shipping costs, insurance, export/import duties, taxes (foreign and domestic) and any other related costs and risks consistent with the designated shipping method shall be borne by Customer for delivery of the Products to Customer’s chosen destination. Shipping dates are approximate and are not guaranteed. Partial deliveries shall be accepted by Customer and paid for at contract prices and terms.


All Products are covered by a Limited Warranty of the Company for a period of 90 days from the date when purchased from Company. COMPANY EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE WITH RESPECT TO THE PRODUCTS PURCHASED BY CUSTOMER. Only standard, non-perishable (i.e., that do not require controlled storage conditions) Products may be returned. All non-standard Products are not eligible for return. Products are deemed accepted by Customer unless Customer notifies Company in writing of a Product shortage, damage or defect within 48 hours of delivery of such Products to Customer (or other location per instructions from Customer). Returns of any type must be approved by Company in writing and an RMA (Return Material Authorization) number must be issued by Company before Company will accept any return or exchange. Returned shipments not approved by Company will be refused by Company. The request for return must include the serial number and full identification of the Products to be returned and a detailed description as to the nature of the defect or problem. Defective or damaged Products must be inspected by a Company Technical Account Manager or other authorized Company representative before any return or exchange consideration will be extended by Company. Products must be returned in the same or equivalent container and packaging materials in which they were shipped. Customer retains title to any Products returned for repair. A restocking fee of the lesser of 10% of the order value or $250, plus any additional expenses incurred by Company to inspect, ship and resell such Products will be imposed on returned Products. Return freight cost is the responsibility of Customer.
